What Requirements May Matter?
For a U.S. patent, potential invalidity grounds depend on the claims, filing date, governing statutory version, evidence, and forum. The following are distinct requirements rather than interchangeable labels.
Patent-Eligible Subject Matter — 35 U.S.C. § 101
Section 101 identifies processes, machines, manufactures, compositions of matter, and qualifying improvements as statutory categories.[3] U.S. Supreme Court precedent also recognizes judicial exceptions involving laws of nature, natural phenomena, and abstract ideas and applies a claim-focused analysis.[4] It is inaccurate to state categorically that software or business methods are generally valid or invalid without analyzing the actual claims.
Novelty — 35 U.S.C. § 102
For patents governed by the America Invents Act, § 102 defines categories of prior art and statutory exceptions by reference to the claimed invention’s effective filing date.[5] An anticipation analysis generally requires one qualifying reference to disclose every claim limitation, expressly or inherently, arranged as required by the claim.[14] The applicable pre-AIA or AIA law and effective date must be confirmed.
Nonobviousness — 35 U.S.C. § 103

Written Description — 35 U.S.C. § 112(a)
Written description is distinct from enablement. The Federal Circuit’s en banc decision in Ariad v. Eli Lilly asks whether the disclosure reasonably conveys to a skilled person that the inventor possessed the claimed subject matter as of the filing date.[10] The analysis is claim- and disclosure-specific; claim breadth alone does not decide the issue.
Definiteness — 35 U.S.C. § 112(b)
Section 112(b) requires claims that particularly point out and distinctly claim the subject matter regarded as the invention.[8] Under Nautilus v. Biosig, a patent is indefinite if its claims, read in light of the specification and prosecution history, fail to inform skilled persons about the scope of the invention with reasonable certainty.[11] The presence of a relative term does not by itself establish indefiniteness.
Jurisdiction-Specific Validity Standards

An enablement review compares the full scope of the claims with what the specification teaches a skilled person to make and use. Relevant considerations may include the breadth of the claims, predictability of the field, working examples, guidance in the specification, and the amount and nature of experimentation required.[9]

Written Description Challenges
The inquiry focuses on what the application disclosed as of the relevant filing date. It asks whether the specification’s four corners, viewed through the knowledge of a skilled person, reasonably convey possession of the claimed subject matter.[10]

Indefiniteness Challenges

Overall Assessment

Conduct a Full Analysis When
- A claim remains materially relevant after infringement screening.
- The patent affects a major launch, license, transaction, design, or dispute decision.

- The chosen forum, timing, and available evidence justify deeper work.
Conduct a Limited Review When
- The purpose is to decide whether a full search or opinion is warranted.
- Only a small number of claims or prior-art leads require initial triage.
- A near-term business meeting needs clearly bounded questions, not a legal conclusion.
Label the scope, sources, time limit, jurisdictions, and unreviewed issues so that a limited review is not mistaken for a complete validity opinion.
